Terms of Service

• To create your own account, you must be at least 13 years old. Children under 13 may use the Service only as part of a family plan managed by a parent or legal guardian.
• If you create a family plan, you are responsible for the conduct of every member you add and for ensuring you have the right to add them.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating an account and to keep that information up to date.
• Age accuracy. Contests are organized into age brackets, and prizes are awarded based on the date of birth associated with each account or family member profile. You agree that every date of birth you submit — for yourself or for any family member — is accurate. Misrepresenting age to enter a contest you would not otherwise be eligible for is a material breach of these Terms and may result in disqualification of affected entries, forfeiture of prizes (including clawback of prizes already shipped), and termination of the offending account.
• Proof of age and identity. We may, at our discretion and at any time, ask you to provide reasonable verification of any account holder's or family member's age and identity — for example before shipping a prize, when investigating a suspected violation of these Terms, or in response to a complaint. Acceptable forms of verification may include a photograph of the builder with their entry, a redacted document showing date of birth, or other comparable evidence we specify. If verification is not provided within a reasonable time, we may withhold prizes, disqualify entries, suspend voting eligibility, or close the account.

You retain ownership of the photos, captions, animations, and other content you upload or generate ("Your Content"). By uploading or creating Your Content, you grant BrickyBrick a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works from (including AI-generated animations), display, and distribute Your Content for the purpose of operating, promoting, and improving the Service.

You represent and warrant that you own or have the rights necessary to upload Your Content and to grant us this license, and that Your Content does not violate any law or third-party right.

You agree not to:

• Upload content that is illegal, sexually explicit, hateful, violent, harassing, or otherwise harmful, particularly toward minors.
• Upload content you do not have the right to share, including copyrighted or trademarked material.
• Attempt to bypass moderation, abuse the contest or credit systems, manipulate votes or XP, or create fake accounts.
• Reverse engineer, scrape, or programmatically access the Service except as expressly permitted.
• Interfere with the Service's operation or with other users' use of the Service.
• Use the Service to violate any applicable law or regulation.

We reserve the right to remove content, restrict features, or suspend or terminate accounts that violate these Terms or that we otherwise believe pose a risk to users or the Service.

• Paid plans (Individual and Family) are billed in advance on a recurring basis through Stripe. Pricing is shown on the Plans page.
• You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; we don't prorate refunds for partial periods unless required by law.
• Credits used to generate animations or enter paid contests are consumed when used and are non-refundable, non-transferable, and have no cash value.
• We may change pricing, plan features, or credit costs from time to time. Material changes to existing paid subscriptions will be communicated in advance.
• Family plans support a base number of members with optional paid additional members. Adding members beyond the included count may increase your subscription cost.

• Each contest may have its own rules, eligibility requirements, entry limits, judging criteria, and prizes. The contest page is the authoritative source for those rules.
• By entering a contest, you grant us the right to display your entry, your display name, and your animations in association with the contest.
• Prize fulfillment may require providing a shipping address. If you cannot or will not provide one, we may select an alternate winner.
• We reserve the right to disqualify entries that violate these Terms, the contest rules, or that we believe involve cheating, manipulation, or fraud.

BrickyBrick uses third-party AI services to generate animations, names, and other content from your uploads. AI output may contain errors or unexpected results. You are responsible for reviewing AI-generated content before sharing it. We do not guarantee any particular result and may modify or discontinue AI features at any time.

The Service, including its software, design, branding, and original content (excluding Your Content), is owned by BrickyBrick or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

If you believe content on BrickyBrick infringes your copyright, email support@brickybrick.com with the details required by the DMCA (description of the work, URL of the infringing material, your contact information, and a good-faith statement and signature).

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if continuing to provide the Service to you would expose us or other users to risk. Sections of these Terms that by their nature should survive termination will survive (including content licenses, intellectual property, disclaimers, and limitations of liability).

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that AI-generated content will meet your expectations.

To the maximum extent permitted by law, BrickyBrick and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

You agree to indemnify and hold BrickyBrick harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

These Terms are governed by the laws of the United States and of the state in which BrickyBrick is organized, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of the page and, for material changes, notify you via email or an in-app notice. Continued use of the Service after a change means you accept the updated Terms.
